The terms “we,” “us,” and “our” refer to CrossGearX. CrossGearX operates this store and website, including related information, content, features, tools, products, and services in order to provide you, the customer, with a curated shopping experience (the “Services”).

CrossGearX is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service, together with any policies referenced herein (collectively, the “Terms”), describe your rights and responsibilities when you access or use the Services.

Please read these Terms carefully. They include important information regarding your legal rights, purchases, warranty disclaimers, and limitations of liability.

By visiting, interacting with, purchasing from, or otherwise using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms or our Privacy Policy, you should not access or use the Services.

By agreeing to these Terms, you represent that you are at least the age of majority in your state of residence, or that you have given consent for your minor dependents to use the Services on devices you own, purchase, or manage.

To use certain Services or make a purchase, you may be asked to provide information including your email address, billing information, payment information, and shipping information.

You agree that information you provide will be accurate, current, and complete and that you have the necessary right to provide that information.

You are responsible for maintaining the security of any account credentials and for activity conducted through your account.

SECTION 2 – OUR PRODUCTS

CrossGearX makes reasonable efforts to accurately represent our products, designs, colors, sizes, and other product characteristics.

However, colors and product appearance may vary depending upon your device, screen settings, production method, garment, materials, and other factors.

Many CrossGearX products are made to order and are produced specifically after an order is placed. Minor variations that naturally occur during printing, embroidery, manufacturing, or fulfillment and fall within reasonable production tolerances are not necessarily considered defects.

Product descriptions, availability, designs, pricing, and specifications may be changed without notice.

We reserve the right to discontinue products or limit quantities available for purchase.

SECTION 3 – ORDERS

When you place an order, you are making an offer to purchase products from CrossGearX.

CrossGearX reserves the right to accept, decline, or cancel an order when reasonably necessary, including because of product availability, pricing or listing errors, suspected fraud, payment issues, or other circumstances affecting our ability to fulfill the order.

Payment must be successfully received and processed before an order can be fulfilled.

Please carefully review your order before submitting it, including product, size, color, quantity, personalization where applicable, and shipping address.

Because many CrossGearX products are made to order and may enter production shortly after an order is submitted, we may be unable to cancel or modify an order after production begins.

Purchases are subject to our Return & Refund Policy.

Products purchased through CrossGearX are intended for personal or household use unless otherwise agreed.

SECTION 4 – PRICES, PAYMENT, AND BILLING

Prices, discounts, and promotions may change without notice.

The price charged for a product will generally be the price displayed when the order is placed, subject to correction of obvious errors.

Unless otherwise stated, displayed product prices do not include applicable taxes or shipping charges. Any applicable charges will be presented during the purchase process.

You agree to provide current, complete, and accurate purchase and payment information.

You represent that you are authorized to use the payment method submitted for your purchase.

SECTION 5 – SHIPPING AND DELIVERY

CrossGearX currently ships within the United States only. We do not offer international shipping at this time.

Because products may be made to order and produced or fulfilled through different facilities, processing and delivery times may vary.

All delivery dates and timeframes are estimates unless expressly stated otherwise. Delivery may be affected by carriers, weather, production delays, high-volume periods, fulfillment facilities, delivery-location restrictions, and circumstances outside CrossGearX's reasonable control.

Products within the same order may occasionally arrive in separate packages and at different times.

Shipping, tracking, delayed or missing packages, incorrect addresses, and related matters are governed by our Shipping Policy.

If you experience a shipping problem, please contact CrossGearX so we can review the available information and help determine an appropriate resolution.

SECTION 6 – RETURNS, REFUNDS, AND PRODUCT ISSUES

Because many CrossGearX products are made specifically after an order is placed, we generally cannot accept returns, exchanges, or provide refunds because of:

• Ordering the wrong size or color
• Ordering the wrong product or variation
• A change of mind or buyer's remorse
• Personal preference regarding fit, style, or appearance
• Incorrect or incomplete information supplied when ordering

If an order arrives damaged, defective, misprinted, or contains an incorrect item, please contact CrossGearX within 10 calendar days of delivery.

Claims are reviewed individually and may require photographs, video, packaging information, shipping labels, or other reasonable documentation needed to verify and resolve the issue.

Approved claims may result in an appropriate replacement, reprint, refund, or other resolution depending upon the circumstances.

Nothing in these Terms is intended to limit rights or remedies that cannot legally be limited under applicable consumer-protection laws.

SECTION 7 – INTELLECTUAL PROPERTY

The CrossGearX Services and their content, including trademarks, brand names, logos, original designs, graphics, text, photographs, video, audio, product presentations, and the selection and arrangement of such materials, may be owned by CrossGearX or used under license and may be protected by applicable intellectual-property laws.

The Services are provided for personal, non-commercial use.

Unless authorized by CrossGearX or otherwise permitted by law, you may not reproduce, distribute, modify, republish, commercially exploit, or create derivative works from protected CrossGearX content.

CrossGearX names, logos, designs, product names, and slogans may not be used in a manner that infringes applicable intellectual-property rights.

Shopify's names, logos, products, and related marks belong to Shopify or its applicable licensors. Other trademarks appearing through the Services belong to their respective owners.

SECTION 8 – OPTIONAL TOOLS AND SERVICES

We may provide access to tools, features, applications, integrations, or services offered by third parties.

We may not monitor or control those third-party tools.

Third-party tools may be provided “as is” and “as available,” and your use of them may be subject to the applicable third party's terms and policies.

We may introduce additional tools, resources, or features in the future. Unless otherwise stated, those features will also form part of the Services and will be subject to these Terms.

The Services may contain links to websites or services operated by third parties.

CrossGearX does not control those third-party websites and is not responsible for their content, accuracy, privacy practices, security, products, or services.

If you access a third-party website, you should review its applicable terms, privacy policies, and practices before conducting transactions or providing personal information.

Questions or disputes concerning products or services provided directly by a third party should generally be addressed to that third party.

SECTION 10 – RELATIONSHIP WITH SHOPIFY

CrossGearX is powered by Shopify, which enables us to provide the Services to you. However, sales and purchases made through our store are made directly with CrossGearX.

By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of sales between you and CrossGearX, including injury, damage, or loss resulting from purchased products and services.

To the extent permitted by applicable law, you release Shopify and its affiliates from claims, damages, and liabilities arising from or related to purchases and transactions made directly with CrossGearX.

SECTION 11 – PRIVACY

Personal information collected through the Services is handled in accordance with our Privacy Policy.

Because our Services are hosted by Shopify, Shopify may collect and process personal information relating to your access to and use of the Services in order to provide and improve Shopify's services.

Information submitted through the Services may also be transmitted to Shopify and other service providers as reasonably necessary to operate the store, process transactions, fulfill orders, provide customer service, prevent fraud, and provide other Services.

SECTION 12 – FEEDBACK, REVIEWS, AND SUBMISSIONS

If you voluntarily submit reviews, suggestions, ideas, feedback, photographs, comments, or other content to CrossGearX (“Feedback”), you represent that you have the right to provide that material.

Unless otherwise agreed, you grant CrossGearX a non-exclusive, worldwide, royalty-free right to use, reproduce, publish, display, and distribute Feedback for purposes reasonably related to operating, improving, and promoting CrossGearX and its products and Services, subject to applicable law.

Feedback must not violate another person's intellectual-property, privacy, or other legal rights, contain unlawful or malicious material, or intentionally mislead others regarding its origin or authenticity.

SECTION 13 – ERRORS, INACCURACIES, AND OMISSIONS

Occasionally, information on the Services may contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, availability, shipping charges, delivery estimates, or other information.

CrossGearX reserves the right to correct errors or inaccuracies and update information when reasonably necessary.

If a material error affects an order already submitted, CrossGearX may contact you regarding an appropriate resolution, including correcting or canceling the affected order when necessary.

SECTION 14 – PROHIBITED USES

You may use the Services only for lawful purposes.

You may not use the Services to:

• Violate applicable laws or regulations
• Infringe intellectual-property or other legal rights
• Harass, threaten, abuse, defame, or unlawfully harm another person

CrossGearX may restrict or terminate access when we reasonably determine that these Terms have been violated.

SECTION 15 – AUTOMATED AGENTS AND AI TOOLS

Automated or semi-automated software, services, artificial-intelligence agents, bots, crawlers, or similar technologies (“Agents”) may not access or interact with the Services in violation of these Terms or applicable technical restrictions.

Agents must not conceal their automated nature, circumvent CAPTCHAs or other security measures, impersonate human users, bypass access restrictions, or evade measures intended to control automated access.

CrossGearX may use reasonable technical measures to limit, restrict, or block automated access to the Services.

SECTION 16 – TERMINATION

CrossGearX may suspend or terminate access to the Services when reasonably necessary, including in response to violations of these Terms, unlawful activity, fraud, misuse, security concerns, or other conduct that may harm CrossGearX, customers, Shopify, service providers, or others.

Obligations and provisions that by their nature should survive termination will continue to apply.

SECTION 17 – DISCLAIMER OF WARRANTIES

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

CROSSGEARX DOES NOT GUARANTEE THAT THE SERVICES WILL ALWAYS BE UNINTERRUPTED, ERROR-FREE, COMPLETELY SECURE, OR AVAILABLE AT ALL TIMES.

EXCEPT FOR WARRANTIES OR RIGHTS THAT CANNOT LEGALLY BE DISCLAIMED, CROSSGEARX DISCLAIMS WARRANTIES OR CONDITIONS NOT EXPRESSLY PROVIDED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Some jurisdictions do not permit certain warranty limitations, so some of these limitations may not apply to you.

SECTION 18 – LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, CROSSGEARX AND ITS AFFILIATES, PARTNERS, EMPLOYEES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICES OR PRODUCTS PURCHASED THROUGH THE SERVICES.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.

SECTION 19 – INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify and hold harmless CrossGearX, Shopify, and their respective affiliates, partners, employees, agents, contractors, licensors, and service providers from third-party claims, damages, liabilities, or reasonable costs arising from your material breach of these Terms, violation of applicable law, violation of another party's rights, or unlawful misuse of the Services.

SECTION 20 – SEVERABILITY

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the fullest extent permitted by applicable law or severed as necessary.

The remaining provisions will continue in effect.

SECTION 21 – WAIVER; ENTIRE AGREEMENT

Failure by CrossGearX to enforce a provision of these Terms does not constitute a waiver of that provision or any other right.

These Terms, together with the policies and other operating rules posted through the Services, constitute the agreement governing your use of the Services, subject to applicable law.

SECTION 22 – ASSIGNMENT

You may not transfer or assign your rights or obligations under these Terms without our prior written consent except where such restriction is prohibited by law.

CrossGearX may transfer or assign its rights and obligations as permitted by applicable law.

SECTION 23 – GOVERNING LAW

These Terms and any separate agreements through which CrossGearX provides Services will be governed by applicable federal law and the laws of the state in which CrossGearX is headquartered, without limiting any consumer rights that cannot lawfully be waived.

Any dispute concerning these Terms will be handled in accordance with applicable law and jurisdictional requirements.

Your continued use of the Services following an effective change constitutes acceptance of the revised Terms to the extent permitted by applicable law.
